As we head into unprecedented economic volatility, what risks will emerge in 2023?

We expect to see an upswing in litigation and regulatory enforcement action that typically accompany economic slowdowns.  In the US, the DOJ, the SEC, and FINRA have signalled that corporate wrongdoing will not be tolerated.  In the UK, the new Consumer Duty establishes new rules for firms to follow, and firms that do not comply risk enforcement action and consumer litigation.

Companies should expect the DOJ to require prioritization of evidence that will enable it to make cases against individuals.
